New York City mesothelioma attorney Joseph W. Belluck today joined the recent call by U.S. and Canadian advocacy groups for the elimination of the use of asbestos and asbestos-containing products.

The Asbestos Disease Awareness Organization, a national advocacy group for mesothelioma victims in the U.S., joined the Canadian Voices of Asbestos Victims in issuing a declaration last week. The groups called on Canadian Prime Minister Stephen Harper and President Barack Obama to stop the use of asbestos and eliminate asbestos-related disease.

Asbestos is a heat-resistant fibrous material used in a variety of industrial, construction and consumer products. It has been linked to disease since the early 1900s and identified as a carcinogen since the 1920s.

Asbestos fibers easily break down when disturbed. If inhaled, asbestos can result in a usually fatal cancer called mesothelioma, asbestosis and other diseases.

More than 10,000 Americans and 1,000 Canadians die every year of diseases caused by asbestos exposure, the North American Declaration to Eliminate Asbestos says. Mesothelioma, a cancer of the lining of the lungs and abdominal cavity, is among these diseases.

Canada permits the mining and export of asbestos. The U.S. and Canadian governments continue to allow asbestos to be used in some products.

The U.S. Geological Survey says that about 90 percent of the estimated 820 metric tons of asbestos the United States imported in the first seven months of 2010 came from Canada.

Belluck is a nationally recognized attorney whose practice focuses on personal injury and wrongful death litigation based on asbestos-exposure and cases of mesothelioma.

He said most of the people his firm assists are older workers, retirees and military veterans who were exposed to asbestos in the workplace decades ago.

Blouin said, stressing that ?any exposure beyond background levels of asbestos is significant enough to cause disease.?

Said Blouin, ?As for smokers, defendant companies sometimes try to claim they should be absolved of liability because the mesothelioma and peritoneal mesothelioma cancer or lung cancer victim smoked. Here?s the thing though. Smoking can never cause mesothelioma or peritoneal mesothelioma. Regarding other forms of cancer, including lung cancer, epidemiological studies have generally shown that if you are exposed to asbestos, you?re five times more likely to get cancer than you are if you?re someone who is not exposed to it. On the other hand, if you smoke and you?re not exposed to asbestos, you?re 10 times more likely to get lung cancer.?

There is, he continued, ?a synergistic effect if you?re exposed and a smoker ? the two together can make it up to 50 times more likely that you?ll develop cancer.?

New York parks officials must ensure that residents and workers are not exposed to dangerous asbestos fibers during the demolition of nine buildings on the former Kings Park (N.Y.) Psychiatric Center grounds, New York mesothelioma lawyer Joseph W. Belluck said today.

According to a recent article in the Long Island Times Beacon Record, the state?s parks department has secured $ 15 million in funding for the building demolition and will receive bids from contractors over the next two months. The project could begin in May.

The newspaper reported that seven of the buildings set for demolition have been condemned because they contain asbestos or are unsafe to enter. A state parks official said tanker trucks will be used to wet down the demolished structures in order to prevent the asbestos dust from becoming airborne.

Asbestos is the only known cause of mesothelioma, a disease that kills between 2,500 and 3,000 people in the U.S. each year. The most common form of mesothelioma, pleural mesothelioma, arises when asbestos fibers become lodged in the thin tissue that lines the lungs.

Symptoms of the disease, such as shortness of breath and chest pains, may take as many as 10 to 50 years to develop. Once diagnosed, mesothelioma progresses rapidly.

Belluck says it is important for mesothelioma victims to seek legal assistance in addition to medical treatment to learn about their legal options.
